Article 1 - Scope of application
These General Terms and Conditions apply to all sales of products concluded between SRL OYAS BELGIQUE and consumer Buyers, as defined by the Code of Economic Law.
The order of a Product by a Buyer implies knowledge and full and unconditional acceptance of these General Terms and Conditions.
OYAS® BELGIQUE reserves the right to modify these General Terms and Conditions at any time, without notice, it being understood that such modifications will not apply to orders previously accepted by OYAS® BELGIQUE. In the event of modification, the General Terms and Conditions of sale in force on the day of the order will apply to each order.
Article 2 - Formation of the contract
Any sale will be considered validly concluded and the contract deemed perfect between the Buyer and SRL OYAS BELGIQUE, upon receipt of the order confirmation.
Article 3 - Ordering procedures
In order to place an order, the Buyer must provide the mandatory information (name, first name, address, email) necessary for processing their order.
The Buyer agrees to only provide accurate and complete information. In the event of incorrect or incomplete information, OYAS® BELGIUM reserves the right to cancel the order.
Article 4 - Price, payment and payment conditions
The prices of our products are indicated in euros, VAT included.
The applicable prices are those in effect at the time of the order.
For consumer Buyers, payment is due in full at the time of the order.
Article 5 - Delivery
The Products are delivered to the address provided at the time of the order, within an average period of 15 days, given as an indication.
Notwithstanding the above, when the Buyer is a consumer, the transfer of risk occurs at the moment the consumer or a third party designated by them physically takes possession of the Products.
Article 6 - Right of withdrawal, returns and complaints
This article applies exclusively to consumer Buyers.
The Buyer has a right of withdrawal of 14 calendar days from the day of receipt of the Products, without having to justify their decision.
To exercise their right of withdrawal, the consumer must notify their decision in writing (email or registered mail) before the withdrawal period expires.
OYAS® BELGIUM will only respond to the withdrawal if the original packaging of the product remains intact and if the product has not been used or damaged.
Return shipping costs are the responsibility of the Buyer.
Any complaint must be addressed within a maximum period of 15 days after the defect is discovered.
OYAS® BELGIQUE refunds the consumer within 14 calendar days from the notification of withdrawal.
The Products benefit from the two-year legal conformity guarantee provided by the Economic Law Code.
Article 7 - Liability
OYAS® BELGIQUE is subject to an obligation of means.
Its liability cannot be engaged in cases of force majeure or due to an unpredictable and insurmountable event caused by a third party.
Article 8 - Electronic proof
Electronic communications, order confirmations, online payments, and electronic invoices constitute valid and enforceable evidence.
Article 9 - Applicable law and dispute resolution
These General Conditions are subject to Belgian law.
In the event of a dispute, the consumer may resort to mediation or the European online dispute resolution platform (ODR).
Article 10 - Final provisions
The nullity of a clause does not affect the validity of the others.
The French version prevails.
These general conditions are applicable from 01/11/2023.
